6. A.I. Rule Proposals Submitted to the Texas Register – Administrative Procedures Act public comment period has not closed : Continuity of Specialty Care for Certain Medicaid Members. This rule proposes amendments to §353.4, concerning Managed Care Organization RequirementsConcerning Out-of-Network Providers; and §353.7, concerning Coordination of Benefi ts withPrimary Health Insurance Coverage. The purpose of this proposal is to implement Senate Bill (S.B.)1648, 87th Legislature, Regular Session, 2021 that amended Texas Government Code §533.038(g)and added new subsections (h) and (i) to §533.038. Public comment period will end on 5/31/22.

Certification of Managed Care for Contract Award The rule proposes new §353.8, concerning Certifi cation of Managed Care Organizations Prior toContract Awards.The proposal implements Texas Government Code, §533.0035, added by Senate Bill1244, 87th Legislature, Regular Session, 2021 Public comment period will end on 6/13/22.
6. B.I. Not yet submitted to the Texas Register for APA public comment Medicaid Home Health Services This rule proposes amendments to §354.1031, concerning General; §354.1035, concerning RecipientQualifi cations for Home Health Services; §354.1037, concerning Written Plan of Care; §354.1039,Home Health Services Benefi ts and Limitations; §354.1040, concerning Requirements for WheeledMobility Systems; and §354.1043, concerning Competitive Procurement of Durable MedicalEquipment (DME) and Supplies. The purpose of the proposal is in response to recent federallegislation that prompted the Centers for Medicare & Medicaid Services (CMS) to issue interim fi nalrule, CMS-5531-IFC (Interim Final Rule with Comment), to expand the healthcare workforce duringthe COVID-19 pandemic. This rule has not been submitted to the Texas register.
